I'm confused about your question. If you owned a home before filing bk, then any HOA fees were discharged. If after the bk, the home is still under your name, even if you don't live there, then you owe those post petition HOA fees. That's the general rule. Some attorneys have ways around this, others do not know about the rule etc. I am sorry this happened to you but this is why people need to hire attorneys.

The answer depends upon how much you are making and whether your debts are primarily consumer in nature. The UST can object to discharge under the totality of circumstances section of 11 UST Section 707 when your debts are primarily consumer debts and your schedules show the ability to pay some of your debt over the next five years. You should be discussing these issues with the attorney you paid for your case.

Unfortunately the answer is yes. Even though you returned the car, you are still responsible for the debt. It's typical for a creditor to sell the vehicle and then come back to the debtor for the difference of what they sold it for and what was originally owed. Filing bankruptcy will make this go away.
