Is there a federal code 830-88 that is service of a summons?

If this was not a business to business loan, and he is not the original creditor, his actions violate the Fair Debt Collection Practice Act. You should note that to him as you are allowed under Federal law to sue for actual damages, $1500 statutory damage and attorney fees. Find an FDCPA knowledgeable attorney in your area as soon as possible.

How long will it take for the bank to evict us?

It is not an eviction, but a foreclosure. The clerk cannot enter a writ of possession until 11 days after the sale on the courthouse steps. Since a foreclosure has not been filed yet, it is impossible to tell you how much time you might have left in the house. Probably a number of months.

Do I qualify for bankruptcy if I have more credit card and medical bills than the money coming in?

Probably. The first test is whether your expenses exceed your income. You have to find out which bankruptcy chapter to file under next.
