Is she liable for his medical debt and can she be sued for her SS benefits?

Answered by attorney Daniel A. Edelman
Bankruptcy lawyer at Edelman, Combs, Latturner & Goodwin, LLC
Social Security benefits are exempt. Under state law, one spouse is liable for the medical care of the other. Under federal law, each spouse has the right to obtain credit in his/her own name, without the involvement of the other. If the facts show that the husband obtained credit on his own, she would most likely not be liable. Which happened is a factual question. Her liability also depends on why Medicare did not pay the bills. If the bills represent the patient portion, the husband is liable. If the bills were disallowed because not medically necessary, or they were not timely submitted, the patient (or the patient's spouse) may not be liable for them.

Pre bankruptcy HOA debt may be discharged unless the HOA has a lien recorded. Post-petition HOA fees are new debts that are not discharged.

Could I still get a job if I file for bankruptcy?

Answered by attorney Paul Norwood Jonas Ross (Unclaimed Profile)
Bankruptcy lawyer at Paul N. J. Ross Law, PLLC
Yes. Typically filing for bankruptcy does not hurt your job prospects. It is rare that employers will know of your filing unless you have to do a credit check. Even then, your credit will be clear of debt for the most part which may assist. If they are just going off your credit score, that may be different though.
