There are some conflicting opinions on this issue. I assume your plan said you would continue to make payments on the car. However, I would take the position that the debt will be discharged when you receive your chapter 13 discharge and that they cannot now try to collect either because you are in a pending bankruptcy.

Yes you can file separately from your husband however you need to disclose his income and all community assets. So his retirement, accounts, must also be disclosed.

You have to complete the credit counseling prior to filing. In limited situations, you can get a waiver. The majority of the counseling classes online take an hour and will get you the certificate the day you take the class.
