Can medical bills from surgery be collected after I've already filed Chapter 13 bankruptcy?

Answered by attorney Stuart M. Nachbar
Bankruptcy lawyer at Law Office of Stuart M. Nachbar, P.C.
Absolutely yes. If you are in an active BK13, and the surgery was pre-petition, the debt would need to be included in the 13. Have Counsel file an Amendment, serve the Creditor with the 341 Notice, and make sure they file a Proof of Claim.

You need to consult the attorney that handled your bankruptcy. Your partner could have been included in the bankruptcy and you might need to reopen your case to list the partner.

If I don't file a proof of claim, will he stop having to pay future support payments?

Bankruptcy will not change his child support obligation. When he completes the 13, he will have to inform the court that he is still current on his child support as well.
