How long does it take to apply for a credit card after you have been through bankruptcy and I have been though court?

Bankruptcy lawyer at A Fresh Start
Applying for the credit card isn't the problem, the problem is persuading the lender to approve your application. It is unlikely that any lender will approve an application for a credit card until after your bankruptcy case is discharged, or completed. If your Trustee meeting was on 10/19/12, your discharge won't come in until Christmas time.

Is there a timeline or deadline for the trustee to have objections about anything? Can the trustee still go after assesses after my trial date?

A Trustee, like any other creditor, must take actions within the times set out by the Bankruptcy Code. The hearing notice for the first hearing, commonly called the meeting of creditors or 341 notice, sets forth the initial time limits for a Trustee to act. There are, however, ways to extend that time when a Trustee has a valid reason to do so. You need to talk with your attorney about this. If you do not have an attorney, you should contact an attorney at once to advise you on this and many other issues that come up in a bankruptcy case.

What should I do about my credit card charges before filing for bankruptcy?

default-avatar
Answered by attorney Lawrence C. Arany (Unclaimed Profile)
Bankruptcy lawyer at Arany & Associates
The best thing you can do is discuss this issue with your bankruptcy attorney. The facts in your situation will dictate his/her advice. Often its wise to make the minimum payments. On the other hand, if you can point to a significant financial event that caused you to realize that a BK had to be filed, then in that case, provided there are no other charges made following that event, you would be able to withstand a discharge-ability complaint. You must certainly stop using the card!
