As long as you continue to pay the mortgage on the house, the mortgage company cannot take your house away. I would suggest that you check your credit report & FICO score 3 or 4 times a year for the next two years. It is very likely that the mortgage company will report on your credit that the debt is in bankruptcy, which is true. Should the mortgage company report by mistake that you are in bankruptcy, you should immediately dispute this claim. By checking your credit score with FICO (the only company that creditors use when making a decision whether to lend to you), you can see if any misinformation has harmed you and get to work to correct it.

This all depends on who owns the home legally. What name is on the deed? What name is on the mortgage? Do you have some written agreement that pledges the home as collateral? Generally speaking you have to agree to pledge a property as collateral before someone can place a lien on it.

There is no minimum debt requirement to file bankruptcy. However, a debtor is not entitled to a discharge if the debtor has been granted a discharge in a prior chapter 7 or chapter 11 case commenced within 8 years before the date of filing the new bankruptcy petition or, in situations involving a discharge in a prior chapter 13 case, within 6 years before the date of filing the new bankruptcy petition. We therefore counsel our clients to attempt to refrain from filing bankruptcy, especially in situations where the debt is small, unless there is no other option.
