I suppose a bankruptcy trustee can convince a bank to take a deed in lieu, but forcing them to take a deed in lieu would not be the correct terminology. A trustee can only force certain things, and this is not one of them.

I would get the forms approved by the court first? If they don't approve, the bank may be forced to make concessions to meet the bankruptcy court's objections.

Nothing you describe would stop you from filing bankruptcy. But if the fault in the accident was from driving under the influence, you may not be able to discharge this debt in a Chapter 7 bankruptcy.
