Can the bank file an unsecured claim in my new bankruptcy13 case?

If the bank files a claim that you believe was discharged in a prior bankruptcy, you can file an objection to the claim indicating that the claim was discharged. The bank would then have to tell the court why it believes that the claim is still valid. Most likely, they would just withdraw their claim.

What should I do if a credit card company filed a civil action hearing against me?

If you are being sued you have legal rights, including the right to try to settle the case. If you are currently unemployed and can' t make a payment you can still set something up based on your returning to work. Good luck!

Is it legal to not file my bankruptcy until the payments have been fulfilled?

Answered by attorney Michael Jay Berger
Bankruptcy lawyer at Law Offices of Michael Jay Berger
For a Chapter 7, this is a usual practice. For a Chapter 13, many law firms accept attorneys fee payments through the Chapter 13 plan. For qualified wage earners, I will file a Chapter 13 with payment of the filing fee only before I file the Chapter 13 and all attorneys' fees paid through the Chapter 13 plan.
