How do I get a bankruptcy off of my credit report?

default-avatar
Answered by attorney Sanaz Sarah Bereliani (Unclaimed Profile)
Bankruptcy lawyer at Bereliani Law Firm, PC
Unfortunately you cannot get the bankruptcy information off of your credit report and it will be there for 10 years. After you finished your bankruptcy your attorney (if you had one) should've informed you of how to rebuild your credit. Most mortgage companies these days are willing to work with people on new mortgages 2-3 years after bankruptcy. It sounds like you want to get an unsecured loan to get the property, however, maybe you'll have a better chance at a mortgage as it'll be secured by the new home. I would have an attorney that handles bankruptcy and credit repair to review your credit report and see how they can help you rebuild your credit or get new loans.

Should I fire my bankruptcy attorney and get another before the 341 meeting scheduled with creditors?

Answered by attorney Rustin Scott Polk (Unclaimed Profile)
Bankruptcy lawyer at Polk & Associates
You are allowed to switch lawyers whenever you feel like it. Whether you SHOULD fire your attorney or not is never a clear-cut yes-or-no question. In figuring out whether you want to do that or not, don't focus on what they did or didn't do up to this point. Instead, ask yourself what else you think they should have done, or what you think you've paid them to do but that they haven't done. Then once you know VERY SPECIFICALLY what it is you think they were supposed to do but didn't, ask yourself whether the next lawyer is going to do those specific things or not.

What will happen to my 20 foot trailer if I filed chapter 7?

default-avatar
Answered by attorney Kathryn Ursula Tokarska (Unclaimed Profile)
Bankruptcy lawyer at Law Offices of Kathryn Tokarska
The answer depends. Do you have equity in the trailer? Often, when items are brought on credit there is very little equity, if any, at the beginning of the loan. If so, can it fit into one of the California exemptions: vehicle, wildcard, tools of trade? The last one may be applicable if the item is used as a tool in business. You say you are using the trailer to transport items for others and earning money for doing so.
