Should I file for bankruptcy if I am back on a loan?

Did you sign the title over to your parents? The trustee is not interested in taking the car unless it is a rare and expensive one. Do not register it in their name. Hire a bankruptcy attorney. Do not think that a petition preparer can get it done cheaper. They cannot give legal advice and you need a lot of that.

Do I have to have my Chapter 13 dismissed to get divorced?

Sean Thomas Flynn
Answered by attorney Sean Thomas Flynn (Unclaimed Profile)
Bankruptcy lawyer at The Law Offices of Sean T. Flynn, PLLC
You do not have to dismiss the chapter 13 case. You just have to file a motion to lift stay so that the state court can enter the final decree of divorce and divide up property.

When one files Bankruptcy, does that relieve them of paying a Court Ordered payment through n Divorce?

Answered by attorney Eric Allen Maskell (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Eric A. Maskell
It depends on the court ordered payment. Only domestic support obligations are non-dischargeable. Often times if the court orders someone to pay attorney fees or some other debt that is not considered a domestic support obligation the liability can be discharged in a bankruptcy. You should consult a bankruptcy attorney that has experience in family law to discuss your options.
