When one files Bankruptcy, does that relieve them of paying a Court Ordered payment through n Divorce?

Answered by attorney Paul Norwood Jonas Ross (Unclaimed Profile)
Bankruptcy lawyer at Paul N. J. Ross Law, PLLC
It depends on whether you file Chapter 7 and Chapter 13, the type of payment ordered in the divorce decree, and more. The general rule of thumb is no, but there are exceptions in Chapter 13 in the right circumstances.

Can I include a unemployment benefit overpayment when filing for bankruptcy?

default-avatar
Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
You have no choice, you must list all of your debts in your bankruptcy. While over payment of unemployment benefits can typically be eliminated through bankruptcy, if there is a tax lien, you have been exceptionally unlucky, as liens of this nature cannot be eliminated through bankruptcy. However, if the equity in your property is less than the amount of the lien, the lien may be lowered to the total value of your property. Sorry, state exemptions dont apply!

What can I do if I can't afford chapter 13 payment and my attorney won't help?

Charles J Schneider
Answered by attorney Charles J Schneider (Unclaimed Profile)
Bankruptcy lawyer at Charles J. Schneider, P.C.
Sometimes an amount has to be paid in a chapter 13 case whether one can afford it or not to reach a goal that the client wants. Sometimes attorneys who receive a flat rate and do not charge by the hour will not respond to client phone calls as they do not make any more money for doing so. Sometimes attorneys do not wish to take over another attorney's case because the attorney that they replace may have messed the case up badly and there will be disgruntled clients that have lost their faith in attorneys in general and therefore will be difficult.
