Can a student loan more than 15 years old and payday loans be discharged in bankruptcy?

Answered by attorney Myron Wayne Tucker (Unclaimed Profile)
Bankruptcy lawyer at Orrock, Popka, Tucker Dolen
Payday loans, yes. Student loans, probably not. There are exceptions to these general guidelines, but most will be treated the same as described.

My daughter is on her fiance's house title but not on any mortgage. If he files bankruptcy will it affect her financially?

Answered by attorney Mark J Markus
Bankruptcy lawyer at Law Office of Mark J. Markus
I'm not exactly sure what you mean by "financially" as that is quite broad.  Your daughter is obviously not responsible for her fiance's debts, so his failure to pay them--whether inside or outside of a bankruptcy case--should not affect her.  However, depending on which bankruptcy chapter he filed, the equity in the house, exactly how title is held, and what exemptions are available under applicable state or federal law, the house itself might be at risk. Mark Markus has been practicing exclusively bankruptcy law in California since 1991.  He is a Certified Specialist in Bankruptcy Law by the State Bar of California Board of Legal Specialization,  AV-Rated by martindale.com, and A+ rated by the Better Business Bureau.

Can my unemployment check be garnished if I can't pay consent judgement payment due to mortgage payment?

Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
Unemployment checks are protected from creditor claims under state law, but if the money is deposited into your bank account along with other money, it may lose its protection. Also, if you owe a debt to your bank, the protection may not be available to you because of a contract provision called "set off." I would need to know more about your situation to be able to provide you with a complete answer.
