Sadly the limit is on what they can garnish from your wages only. A judgment creditor is allowed to seize and assets they can find up to your debt. if there are questions, you need counsel.

No one can tell you whether to file.  However, 12,000 is not a lot of debt.  You might want to approach the credit union and work out a settlement that will not cost marshal fees or legal fees.  If you have more debt, bankruptcy is an option.
