Since you still own this property, if you get no benefit from the ownership, you may want to take active steps to deal with this issue. Although you don?t personally owe the mortgage debt, the house does owe the mortgage debt. The lender can still foreclose on the house in order to get paid. While a foreclosure may not show up on your consumer credit report, it will be part of your credit history that every mortgage lender will be aware of and can prevent you from obtaining a new mortgage. So do you want to leave things alone or make a little effort to make a little money and sell this house?

Sure. You cannot expect to keep the property that the lien is against, however. For example, if you have a car with a lien and file bankruptcy, can either reaffirm the debt, continue paying and keep the car or stop paying and expect the car to be repossessed.

The problem is that if there is an underlying debt that is a contract and you may be in breach of that. You should not enter into agreements with debt collectors that are not clearly documented. You should have an attorney review the facts to determine whether there is a violation of the Fair Debt Collection Practices Act or other law. It is not unknown for debt collectors to agree to settle on some set of terms and then claim that you did not make payments on time or otherwise violated the deal, so they don't have to honor it.
