Of course, all collections must cease as soon as you file a bankruptcy petitionbut sometimes it's hard to make them stop, and the garnishing creditor can argueif it is sothat they took less than $600 within the 90 days of your filing, so the payment is not a preference as such. Some courts buy this garbage, some do not. Have your lawyer (and you should have one) contact the garnishing creditor and demand the money back. Be sure your lawyer knows the dates and amounts which were taken. This may not work, and then your lawyer, who should know the expectations and practices of judges in your federal district, will be able to gauge the merits or otherwise of bringing a contempt action against the creditor.
