Can a company discuss my late account with a person outside the company, specifically my daughter's teacher?

Answered by attorney John F Brennan (Unclaimed Profile)
Bankruptcy lawyer at Musilli Brennan Associates, PLLC
I think that such discussions are somewhat tacky, but I'm not sure that they are illegal. I assume the instrument is either on some form of purchase plan or rented and that you are behind in the payments and therefore the instrument is subject to repossession under the contract. The company is clearly attempting to pressure you into meeting your obligations.

If I have a court ordered wage garnishment, can the debt collector call me and start sending me bills again?

Answered by attorney Daniel A. Edelman
Bankruptcy lawyer at Edelman, Combs, Latturner & Goodwin, LLC
They can contact you. You have the right to direct them in writing not to contact you. I suggest certified mail or fax so you have proof of receipt. This does not prevent legal action but if you are not collectible you are not collectible.

Can a rent to own furniture company have you arrested for theft?

Answered by attorney Daniel A. Edelman
Bankruptcy lawyer at Edelman, Combs, Latturner & Goodwin, LLC
If they have a right to retake possession of the furniture, you cannot conceal it for the purpose of preventing them from doing so. If they do not know its location, you should disclose that. Other than that, nonpayment of a debt is not criminal.
