What can I do about debt in our divorce?

Cathy Rose Cook
Answered by attorney Cathy Rose Cook (Unclaimed Profile)
Bankruptcy lawyer at Cathy R. Cook, Attorney at Law
A divorce decree making you responsible for the debt does not relieve your ex of liability if her name is on the debt. The collection agency can go after her. Her remedy is to file contempt against you in the divorce case.

What happens if you default on a three hundred dollar loan?

Keith Austin Wellman
Answered by attorney Keith Austin Wellman (Unclaimed Profile)
Bankruptcy lawyer at Wellman Law LLC
The Court aspect of this sounds like a scam that I hear about fairly frequently, usually connected to a payday loan, but usually from some bogus entity other than the payday loan company. In Kansas, and every other state I'm aware of, notification of hearings is done by written summons delivered to the defendant. If you want some peace of mind regarding the Court aspect, call the payday loan company to verify that this entity you're hearing from is bogus and/or call the local Courthouse to verify that there are no pending cases against you. You may however need to settle this debt at some point.

Yes, the trustee may take a tax refund; however, if you use one of your exemptions to cover it, you may be able to preserve it for yourself.
