There is no law that requires the lender give you a loan modification, let alone a third one as you are now asking for. The bottom line is that if you want to keep your home, you must continue to make your mortgage payments, property tax payments and maintain homeowners insurance.

Legally, you have a right of redemption, which means you have the right to pay off the mortgage.Financially, that's probably not very workable. As to the effects on your credit, you always have the right to enter an explanation in the credit file that it wasn't your primary debt, that your liability was created through a co-sign/ guaranty situation.

Right. You have no liability. If you filed jointly, I don't even recommend a short sale but rather that you just let it go into foreclosure. I'd send a letter to the mortgage company with a copy of your discharge and tell them you're not liable to sign anything. If you do sign, make a clear note that you were discharged and you are signing merely as an accomodation to your ex and that you are not liable for ANY further costs.
