If you entitled to a tax refund, it is a part of your bankruptcy estate, and the trustee may be able to take it to pay creditors. I am not aware of a time limit for a federal judge to make a ruling.

Since your bankruptcy has already been filed your husband's mortgage company already received the notice. They will search their records using your social security number and find out you have no account with them and throw the 341 notice away. There is no point correcting the error since it is a harmless error.
