How does filing bankruptcy work?

Bankruptcy lawyer at A Fresh Start
Bankruptcy works because of title 11 of the United States Code. This complex legal system is hundreds of pages long. What you have to do is complete a class called "pre-banktuptcy credit counseling" and determine if you qualify for either Chapter 7 or Chapter 13 based on your unique financial situation. The risk depends on the circumstances but bankruptcy will always damage your credit. I would love to give you more details, but the saying is garbage in, garbage out. With more detailed information as can be obtained through a personal consultation with an experienced bankruptcy attorney, you will get more specific answers to your questions.

Could bankruptcy be right for my situation? If so, which one, 7 or 13?

Your question involves too much detail to be answered briefly here. If the divorce decree provides that you are to pay certain debts and hold your ex-wife harmless from them, they might not be dischargeable in a chapter 7, but probably would be in a 13. Also, Chapter 13 gives you the ability to make some modifications in your debt, which is generally not available in Chapter 7. You really need to talk to an experienced bankruptcy attorney to find out what options are available.

How do I get accounts included in bankruptcy removed from my credit report

William Eugene Maddox
Answered by attorney William Eugene Maddox (Unclaimed Profile)
Bankruptcy lawyer at William E. Maddox, Jr. LLC, Attorney at Law
Filing bankrutpcy does not remove creditors from you credit report.  If you did not reaffirm the debts, they should report as "included in bankrutpcy' and have a $0 balance.  If they do not reflect this way, you should dispute them with each credit bureau online.
