Can I find a bankruptcy attorney to help with a Chapter 11 case?

Answered by attorney Michael Jay Berger
Bankruptcy lawyer at Law Offices of Michael Jay Berger
I am certified by the State Bar of California as a Specialist in Bankruptcy Law. I currently am employed as counsel for the debtor in more than thirty active Chapter 11 cases. 6 of my eight Associate Attorneys work primarily on Chapter 11 cases. We can help you with any Chapter 11 matter. I am skeptical about your statement that you "will do all the paperwork but just need help to file it." There is a lot of paperwork involved in a typical Chapter 11 case, as well as numerous meetings and Court Appearances. Still, I am always happy to offer a free consultation with regards to any bankruptcy matter. Call me: 310 271-6223 if you want to arrange a free consultation with regards to your potential Chapter 11 matter.

Can I sell my house after bankruptcy?

Answered by attorney Mark J Markus
Bankruptcy lawyer at Law Office of Mark J. Markus
If your case was closed, you can sell your house at any time.  It has nothing to do with whether or not the debt was reaffirmed.   The reinvestment within 6 months is a requirement of California law and has nothing to do with bankruptcy.  If you do not reinvest the proceeds into a new homestead within 6 months, then you will not have protection of those proceeds from new creditors (or any creditors not discharged in your bankruptcy case).

What happens to the mortgage deed after bankruptcy?

Answered by attorney Michael Jay Berger
Bankruptcy lawyer at Law Offices of Michael Jay Berger
No, filing bankruptcy does not automatically remove your name from the deed to your home. Your question does not give any indication of why you want to remove your name from the deed to your home.
