Can my cosigner sign modification papers in a bankruptcy?

I think the answer is yes, provided that it is closed bankruptcy case and if, of course, the loan company agrees. If your mother's BK case is still open then the permission of the Trustee might be needed. New Jersey Trustees are usually very cooperative when they deem the request to be reasonable.

Is this legal for my employer got a letter to garnish my wages for a debt that was included in the discharged bankruptcy in 2013?

Giovanni Orantes

Bankruptcy lawyer at Orantes Law Firm
No. It violates the discharge injunction and you should inform the creditor of that right away. If the creditor does not stop the attempt to garnish your wages, you may need to hire a qualifies attorney to enforce the injunction for you. You should also get back all or most of what you pay the attorney from the creditor in addition to recovering Wharton they garnish from you.

What would normal attorney fees be for handling a chapter 7 bankruptcy?

Answered by attorney Kathryn Ursula Tokarska (Unclaimed Profile)
Bankruptcy lawyer at Law Offices of Kathryn Tokarska
By normal I suppose you mean typical. Obviously nobody knows what every single lawyer out there charges but $1,500 is a generally understood to be a mid range price thrown out there. Legal fees depend on what is involved in the case. Some cases require more work than others, hence a difference in fees from one case to another. Unpaid legal fees are debt and so dischargeable in the bankruptcy itself hence attorney will want to be paid upfront before the case is filed and not become a creditor in your bankruptcy case. Payment by check or cash is normal.
