Generally, you'd recover against the business, if it was incorporated, or his estate, if he wasn't. In Nevada, one would sue the Estate, with your dollar amount that would be a small claims action. Sometimes it's not recoverable though.

You have a lot of issues and your situation raises a lot of questions. It the treating counselor willing to opine you wife's problem is work related. Does she have disability. You need to fully explain all of the circumstances to gain an opinion you should act on. Hire an attorney before you make a mistake.
