If I want to file bankruptcy, but I have credit cards that are in good standing, do I need to include those credit cards?

Answered by attorney Marlin E. Branstetter
Bankruptcy lawyer at Marlin Branstetter Attorney at Law
All debts must be listed in your bankruptcy. In my experience the credit cards are cancelled when the bankruptcy is filed even if you are current or have a $0.00 balance.

Why is the mortgage company telling me that my house has been discharged in bankruptcy when it was not included in it?

Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
I don't know why you are insisting that your mortgage wasn't included in your bankruptcy, because it would have been a criminal offense for you not to have included it. I would suggest that you get out your bankruptcy paperwork and look at Schedule D. As long as your mortgage payments are current, you can keep your house and your mortgage company will not foreclose.

Can I file bankruptcy on private student loans?

Answered by attorney Mark J Markus
Bankruptcy lawyer at Law Office of Mark J. Markus
Whether the student loans are private are not is, under the current law, irrelevant.  When you say "file bankruptcy on" I assume you are asking whether or not the student loans are dischargeable.  The answer is the same as it has been for a long time now:  Student loans can only be discharged if you can prove, after trial, that repaying the loans would constitute an "undue hardship" on you as that term is defined by the courts in your jurisdiction. You need to consult with an experienced bankruptcy attorney in your area for more details on that option, but it does require you to meet a very high burden of proof and go through a separate trial after filing a bankruptcy case, so it's not inexpensive. Mark Markus has been practicing exclusively bankruptcy law in California since 1991.  He is a Certified Specialist in Bankruptcy Law by the State Bar of California Board of Legal Specialization,  AV-Rated by martindale.com, and A+ rated by the Better Business Bureau.
