Can i file bankruptcy before my work comp settles

Answered by attorney Lee P. Morgan
Bankruptcy lawyer at Morgan Morgan Attorneys at Law, P.C.
If you have resided in Georgia for more than two years, it is likely that you could file a bankruptcy case and protect your workers compensation benefits.  The Georgia bankruptcy exemptions are found in Section 44-13-100 of the Georgia Code.  There is an exemption for payment on account of personal injury of up to $10,000.  There is also an exemption for payment in compensation for loss of future earnings to the extent reasonably necessary for the support of the debtor and his/her dependents.  So, in most cases the combination of these exemptions will fully protect a workers compensation settlement in a bankruptcy case.  If you have not resided in Georgia for more than two years, you may be required to use another State's exemption code, which could be less generous in protecting your settlement funds. In either case, it is critical that you get personal and specific advice from a bankruptcy specialist before filing a case. Lee Morgan is an attorney in Athens Georgia with more than 30 years experience in bankruptcy, Social Security Disability, and workers compensation.  He offers a free initial consultation in consumer bankruptcy matters.  Call (706)548-7070.

Should I wait until my divorce is final and then file for bankruptcy?

default-avatar
Answered by attorney William Monroe Rubendall (Unclaimed Profile)
Bankruptcy lawyer at William Rubendall Attorney at Law
One factor to consider is the exemptions you are allowed to claim for your assets. You may need your spouse's permission, called a spousal waiver, to claim certain exemptions. If you can obtain the waiver you won't have to wait.

I have a company threatening to take me and my daughters to court if I dont pay money I cant afford, what can I do?

Maureen O'Malley
Answered by attorney Maureen O'Malley (Unclaimed Profile)
Bankruptcy lawyer at Maureen O'Malley
They're bottom-feeders. They can't show up and take you to court, and your debts have nothing to do with the assistance you receive. Is your daughter a co-signer? If not, they need to leave her out of it. Send them a letter telling them to provd the debt and how it was calculayed, demand to sed your agreement to pay as well as a copy of the alleged emails. Then tell them not to call you. Send it certified, return receipt requested; if they don't respond appropriatey within 30 days, they're barred from further action. And if they call again making threats before you get the letter out, tell them to come on over and you'll have the police waiting for them.
