Assuming this is the mortgage lender, not HOA, you listed the creditor on your petition, you did not reaffirm the mortgage loan then the lawsuit is a violation of the discharge order. You can contact the counsel for the Plaintiff, explain the situation, give them copy of discharge order and/or provide them with a case # so that they can look up the court docket themselves. If this doesn't compel the Plaintiff to dismiss the case or you wish to start with a more aggressive approach you can reopen the bankruptcy and file motion for violation of discharge order asking for sanctions. You'll want to get an attorney for the more aggressive approach. Legal fees will be paid by the Plaintiff provided you prevail.

To answer what assets you are able to keep in chapter 13 bankruptcy, you must consider the following factors: 1) the equity value in your assets; 2) whether the exemption statutes will fully exempt your equity in the asset; 3) which set of exemptions provide the most protection for your total assets, and finally 4) how much your chapter 13 plan will pay to unsecured creditors. It is good to see a bankruptcy attorney early in order to plan your bankruptcy to get the most benefit.

If the government has overpaid benefits to your wife they are entitled to recover it from her. I don't believe that you would be responsible for the debt unless the government could trace the money that was overpaid to you. You could take the position that you were an innocent spouse.
