You can file by yourself (without your husband filing). However, if your husband is not filing, you must include information about him (his name, income, etc.). When you file a bankruptcy petition, you use your current name and you must also list any other name that you have used

If they are not your bills you need not pay them. If your mother is unable to pay them and she has no assets then there is no need to do anything. You can advise the creditors that she has no assets and is in a nursing home.

The best way to handle it is to ask the future lawyer to replace the current lawyer and have the new lawyer decide whether the present case can be salvaged or whether a new case may be beneficial and guide you on how to do this. If this was not explained by the new attorney I would also be nervous about him or her.
