Can I inherit property while in a chapter 13 bankruptcy?

Answered by attorney Sharon M. Siegel
Bankruptcy lawyer at Siegel & Siegel, P.C.
This is a very complex matter, which intersects bankruptcy and estates law. In general, the information you got is wrong. Post petition assets in a Ch. 13 can be claimed by the trustee. The house is not yours, but your share may be. You need to take very specific actions in the trust and the bankruptcy. Do not discuss this matter with the trustee of your trust or your bankruptcy until you have spoken to a lawyer. Too much information to the wrong person will cost you. I have just finished a case just like yours, and the matter needs to be handled very carefully to preserve as much assets as possible.

If I file bankruptcy in 2010 and they want to undo now, what are the consequences knowing all my mortgages have been satisfied?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Bankruptcy lawyer at Richard B. Jacobson Associates, LLC
Of course you should discuss this with your own lawyer. Generally speaking, if a mortgage (or other) note has been paid through the Ch. 13, then it is paid, whether your Ch. 13 is dismissed, or you get a discharge. When you say 'they want to undo it'do you mean someone has moved to dismiss your case? Or something else? After five years I should think you are so near the end of the case that a dismissal would be unlikely.
