You can file prejudgment, but landlord can proceed with eviction process if he gets court to lift automatic stay which will be granted. See a lawyer.

A deed in lieu is asking the mortgage company to do a favor for you so they are entitled to ask for whatever they wish in exchange for this favor. I suspect you might do better with a short sale instead.

The bank would still own it but maybe they just dont care. Contact them first. After 10 years it may be they just give you the car.
