If your case was not dismissed WITH prejudice (which would be rare and likely due to some type of non-disclosure or fraud), then yes a case could be filed. A Motion to Extend the Automatic Stay would have to be filed explaining the situation though. Other questions remain as well, such as whether a feasible plan can be filed now.

There is no legal limit. But if it's less than $5000 and you're not being garnished, it hardly seems worthwhile.

It seems to me your attorney does not know how to do the means test. Just because you are above the median income does not mean you cannot qualify to file a chapter 7 bankruptcy. You may need to find another attorney with more experience.
