Will I be able to keep my home if I got a discharge from my chapter 7 bankruptcy?

Answered by attorney Magnolia Zarraga (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Magnolia Zarraga
You cannot keep your home unless you pay back all the arrears (months behind) on your house. Alternatively you can ask the lender for a modification which can extend the term of your loan and bring you current. Absent lender agreement or you catching up with your payments, the lender has the right to commence foreclosure on your home or continue foreclosure if it had already began prior to you filing the bankruptcy. How much time you may have in your home depends on a lot of facts which you do not give, contact your attorney, they are in the best position to assist you. If you have steady income, you might consider filing a chapter 13, that would allow you to repay the arrears over 3-5 years, but you would have to have the ability to continue to make your regular mortgage payment. How can I receive garnishment letter if I already filed bankruptcy?

Answered by attorney Kathryn Ursula Tokarska (Unclaimed Profile)
Bankruptcy lawyer at Law Offices of Kathryn Tokarska
It happens occasionally that a creditor not necessarily intentionally but by oversight doesn't pull the plug on collection efforts. A quick call to the opposing counsel representing the creditor should clear this up. They don't want to be sanctioned for going against the automatic stay.

Where do I go online to file bankruptcy while on disability?

default-avatar
Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
You as a consumer cannot file bankruptcy online. Only attorneys who have an account with the court can do this. If you are foolish enough to proceed with bankruptcy without legal representation, you may submit your paperwork at the local bankruptcy court clerk's office. But frankly, there may be absolutely no need for you to file a bankruptcy if your only source of income is disability, unless you own assets not protected from creditors under state exemptions. Some people can take advice, some have to learn the hard way.
