You can file a Chapter 13 bankruptcy but you will not be eligible to discharge any of your debts in this second filing.

Do I have to sign a short sale contract?

Diane L Drain
Answered by attorney Diane L Drain (Unclaimed Profile)

You should get legal advice before signing any documents which obligate you to a new debt. You are correct to be concerned about signing a short sale agreement. Few people understand this is a new contract and you will be responsible for the new contract terms. Your bankruptcy should eliminate all your obligations so long as you listed them in the bankruptcy. I do not know where you are in your bankruptcy process, but you should talk to your bankruptcy attorney. I hope this helps.

What should I do if I received documents from my ex-husband bankruptcy chapter 13 motion for 522(q)(1) order?

Answered by attorney Stuart M. Nachbar
Bankruptcy lawyer at Law Office of Stuart M. Nachbar, P.C.
A q1 motion is one to determine whether or not the court will allow the use of state vs. Federal exemptions. You need to consult with bankruptcy counsel.
