I am on disability and have about $7,000 in debt. Can or should I file bankruptcy?

Answered by attorney Michael D. Siegel
Bankruptcy lawyer at Siegel & Siegel, P.C.
While I would need to know more about the debt and your finances, my general opinion is no.  $7000 is a small amount of debt in bankruptcy land, and you would do better negotiating a payment plan, or doing nothing, if you are judgment proof, as SSD benefits are not available for levy.

Can my debtor legally take every penny that I have in my possession leaving me nothing to live on?

Susan Green Taylor

If you have a judgment creditor with whom you do not have a payment plan (or you defaulted on a payment plan), the judgment creditor can take everything up to the amount of the judgment, with interest.

Is it possible to file bankruptcy with SSI?

Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
You do NOT have to be dead for creditors to be unable to get money from you. As long as you keep your SSI income in a separate bank account and never EVER add money into the account from any other source, only the IRS and possibly your student loan company can take this income. If you have a federal student loan, talk to the collector about options to have the loan payments deferred or even eliminated. Your kid would NEVER get over losing a parent over something as inconsequential as debt. While bankruptcy is always an option, frankly, bankruptcy may not be something you need to defeat the creditors.
