You can file a bankruptcy if your expenses exceed your income. You must list all of your assets and all of your debts. You would be filing a chapter 7 if you qualify, and a chapter 13 if you do not qualify for chapter 7. Consult with a bankruptcy attorney.

Most kinds of debts are eligible to be eliminated through bankruptcy, but you would need to provide much more details about the suit to let me say for sure whether this civil suit is one that can be eliminated. Also, just because you want to file bankruptcy does not mean you are ELIGIBLE for bankruptcy...which is why you need to consult a local bankruptcy lawyer in your community.

In order to file bankruptcy in Kentucky - you must meet the means test, You must list all of your assets and all of your debt. If you fall below the median income level for the area in which you live, you can file for Chapter 7 and discharge the debt. If the debt is secured with collateral, you will need to determine if you will keep the collateral, surrender the collateral or make other arrangements. That is a decision to be made with benefit of counsel. Seek out a competent bankruptcy attorney. If you don't qualify for Chapter 7 - you may be able to successfully complete a Chapter 13.
