6 months is the residency requirement in order to file bankruptcy. In some situations it can be less. No one can tell you whether to file bankruptcy without a complete knowledge of your financial circumstances. It is not something you can just go and do, it takes a lot of time.

This all depends on who owns the home legally. What name is on the deed? What name is on the mortgage? Do you have some written agreement that pledges the home as collateral? Generally speaking you have to agree to pledge a property as collateral before someone can place a lien on it.
