Not necessarily. If she is surrendering her interest in the property, she will be discharged from personal liability on the debt. Assuming she has no equity in the property that could possibly be part of her bankruptcy estate, she could sign a quitclaim deed to make things go more smoothly; but the quitclaim deed is not part of the bankruptcy paperwork, and does not go through the bankruptcy court.

Chapter 13 is a debt consolidation and partial repayment plan. The amount of the payment is based on what you can reasonably afford to pay given your budget. If your ability to pay goes down during the repayment term because of less income or higher living expenses, the amount of the payment can be adjusted. The other type of bankruptcy is chapter 7.

I believe you are asking if you get the debt that's owed to you to be declared non-dischargeable.  Dismissal is something completely different. The time deadline for filing a complaint objecting to the discharge of debt is 60 days after the first date set for the meeting of creditors.   Did you allege fraud in your small claims action and did the court make any findings on that?  If not, you may have a difficult time proving the necessary elements in bankruptcy court.
