If you filed a chapter 7 and did not "strip" the second mortgage, you have eliminated the debt by obtaining a chapter 7 discharge, but the equity loan retains its lien. If you do not pay the bank can foreclose, though it might not bother because it would have to take over the first mortgage. You cannot sell without the consent of the equity loan because the company retains the lien.

Usually a bankruptcy over a couple of years old does not hurt your credit that much. However, I would indicate on a credit application that you filed in 2003. They will find out anyway when they run your credit.

Send the mortgage lender and all three major credit unions proof of the bankruptcy discharge via certified mail. The lender should stop the reporting under your social security number based on the discharge.
