First of all, if your husband's attorney is doing anything other than trying to get the best result for your husband, he's committing an ethical violation! His job is to get the best result for your husband. I think it may be a terrible decision to dismiss the Chapter 13 but there is no way to tell. You have a bk attorney so have him/her help you out with this. If they don't know then you need your own bk attorney that is familiar with family law to help you.

Most banks in our area will not consider a mortgage application until two years have elapsed since the discharge in the case. You can get around that if you have a nice deposit to put down to create equity in the home, but that is usually the only exception.

Sometimes an amount has to be paid in a chapter 13 case whether one can afford it or not to reach a goal that the client wants. Sometimes attorneys who receive a flat rate and do not charge by the hour will not respond to client phone calls as they do not make any more money for doing so. Sometimes attorneys do not wish to take over another attorney's case because the attorney that they replace may have messed the case up badly and there will be disgruntled clients that have lost their faith in attorneys in general and therefore will be difficult.
