NO THEY CANNOT SUE YOU IF THE DEBTS WERE DISCHARGED! There are a couple of issues. 1- Did they receive notice of the bankruptcy? 2- Did you have to turn any money or property over to the court as part of your bankruptcy? It may be that the payday lender did not receive notice of your bankruptcy and they are unaware that you filed. If they did receive notice, and you received a discharge, they are violating the discharge order and they can sued for damages plus your attorney's fees.

Sam is the owner of the property until it is foreclosed. He owes post-petition homeowner's fees until the date of foreclosure. He shouldn't pay the latter since the purchaser of the property at trustee's sale will be required to catch up on those fees.

Of course! Bankruptcy is not a program for the impoverished althuogh there are ways in which those who qualify financially can obtain a court order to waive the expenses associated with filing bankruptcy. But most indigent people I see do not need to file bankruptcy, they only want to file bankruptcy to avoid dealing with their persistent creditors.
