A bankruptcy stays on your credit report for 10 years and then automatically is deleted. You can apply for a home loan at any time after filing bankruptcy. Some lenders will want a 2 year time to have elapsed after the bankruptcy discharge.

Yes you can file separately from your husband however you need to disclose his income and all community assets. So his retirement, accounts, must also be disclosed.

I filed for bankruptcy in 2005, can I file again now?

Diane L Drain

You may file a chapter 7 eight years after filing the last chapter 7. You may file a chapter 13 either 4 or 6 years depending on the circumstances. Please understand that filing for bankruptcy is a very complicated process. It is wise to talk to an experienced bankruptcy attorney before deciding to take this important step.
