Is it legal for American Express to perform collection after bankruptcy?

Answered by attorney Stuart M. Nachbar
Bankruptcy lawyer at Law Office of Stuart M. Nachbar, P.C.
As long as they are not going after you personally they are ok. Your reasoning to go after them would be that they are filing a lien against your property after the Bankruptcy was discharged. Have your counsel reopen for violation of the stay.

Was I supposed to do something on my behalf to have it reinstated or was that up to my lawyer?

I'm afraid that you did not understand something. When you file bankruptcy you are REQUIRED to list ALL OF YOUR DEBTS and all of your ASSETS. Apparently, your bank learned about the car even if you didn't list it AS IT SHOULD. It sounds like you are in a Chapter 13 case if your making payments and you MUST obtain COURT permission to finance a car. I'm not sure you completely understand your obligations and the requirements of a Chapter 13. If you filed a Chapter 7, then if you were discharged you don't owe the bank any money, but if you fail to make all the payments they can report the car (they just can't come after you for any deficiency).

What can I do if I filed bankruptcy and have been discharged and now they are trying to foreclose on my house?

If you filed a Chapter 7, you are required to stay current on payments. The Chapter 7 discharges your personal liability but does not make you current on payments. If you are not current, you need to get current or work something out with the mortgage company. If you were current before you filed and stayed current, then you just need to prove you were current to prevent the foreclosure, If you filed a 13 and used the payment plan to get current, you should have a order declaring your mortgage current. You can use this order to show that the foreclosure should be denied.
