What do I do after a win a judgement on a chapter 7 bankruptcy?

Answered by attorney Austin M Hirschhorn (Unclaimed Profile)
Bankruptcy lawyer at Austin Hirschhorn, P.C.
If the business that you have a judgment against has filed for bankruptcy you need to file a claim in the bankruptcy case. If you were mailed a notice about the bankruptcy filing there should have been a claim form and instructions about how to fill it out and file it that were also mailed to you. If you did not receive the claim form you should contact the court where the case is pending and request a claim form.

Is it fair for me to lose my credit union membership if I lose my property?

Answered by attorney Michael Jay Berger
Bankruptcy lawyer at Law Offices of Michael Jay Berger
It is common for credit unions to cancel the membership of anyone who causes the credit union to sustain a loss. Banks usually do not require their depositors to close their accounts if they cause the bank to sustain a loss, such as by not paying their credit card and filing bankruptcy. I find both policies to be fair. In general, banks and credit unions both retain the right to close the account of any depositor if they feel that it is in their best interest to do so.

Can I re-open my chapter and add car to it if the re-affirm agreement was signed Oct 12?

Keith Austin Wellman
Answered by attorney Keith Austin Wellman (Unclaimed Profile)
Bankruptcy lawyer at Wellman Law LLC
You would not need to reopen the case to rescind the Reaffirmation Agreement. But, you must give the Creditor notice of rescission. However, it must be done prior to either 60 days passing from the date the Reaffirmation Agreement was actually filed with the Court or prior to the entry of the discharge, whichever is later. The Agreement may have been filed within the last 60 days as your case was closed about 30 days ago, so it's something to look into immediately.
