How can my husband get a judgment due to identity theft removed?

Answered by attorney Leonard T Schwartz (Unclaimed Profile)
Bankruptcy lawyer at Law Offices of Slotnick & Schwartz
The only way I can think of is to ask the Court to vacate the judgment nd reopen the case based upon the settlement. Or use the settlement as a defense if they attach your property. But without proof of the settlement your chances are not very good.

How much to file for chapter 7?

Laura J Gabel
Answered by attorney Laura J Gabel (Unclaimed Profile)
Bankruptcy lawyer at Gabel, Gudmundsen & Gabel, P.C.
Every attorney charges differently. Our firm charges a flat rate ($2,000) for Chapter 7 bankruptcies in the eastern district of Michigan. The filing fee paid to the court is $306. Some attorneys are cheaper, but make sure whoever you go with dots their i's and crosses their t's. Precision/accuracy is important in bankruptcies.

Can I file bankruptcy and my husband not file bankruptcy?

Answered by attorney Stuart M. Nachbar
Bankruptcy lawyer at Law Office of Stuart M. Nachbar, P.C.
Yes it is possible for one spouse to file for bankruptcy and the other not to, but the non-filing spouses income is still going to be considered when calculating under the means test which determines if one can file a chapter 7 or must file a chapter 13. Recommend that you talk to a bankruptcy practitioner.
