I had a doctor's bill turned over to a collections agency, the collection company is charging interest, are they allowed to do this?

Answered by attorney Daniel A. Edelman
Bankruptcy lawyer at Edelman, Combs, Latturner & Goodwin, LLC
The answer depends on your agreement with the provider, the rate of interest, whether it was first imposed by the provider or the collector, and whether if the latter notice of the proposed addition of interest was given. An attorney has to review the facts to give a precise answer.

If I filed chapter 7 on Dec 31 2016, do I need a defense for a motion for relief from automatic stay?

There is little chance the lender will go forward with a nonjudicial foreclosure before your move-out date. I wouldn't oppose the motion.

What do I do about a court summons for credit card debt?

You can file bankruptcy prior to the hearing by hiring a bankruptcy lawyer. But you have no money to do that. The best thing to do is to file a response denying the debt, or the amount. People are not jailed for failing to pay consumer debts, they may be jailed for refusing to follow court orders.
