Should I wait until my divorce is final and then file for bankruptcy?

One factor to consider is the exemptions you are allowed to claim for your assets. You may need your spouse's permission, called a spousal waiver, to claim certain exemptions. If you can obtain the waiver you won't have to wait.

There is no set fee or formula as to charging for an emergency motion in bankruptcy. Consult with several attorneys before retaining someone on an emergency basis.

What can I do if I am getting an email from a payday loan trying to take me to court when I was discharged in 2010?

Answered by attorney Marjorie A. Guymon
Bankruptcy lawyer at Goldsmith & Guymon, P.C.
Double check your petition and make sure you listed the creditor. If you did, send a copy of your discharge order and petition to them and tell them if they continue to attempt to collect the debt you will seek sanctions against them. If they continue, file a motion in bankruptcy court.
