If we file for bankruptcy and leave the country, do I have to repay the loan? How does the repayment work?

If you have a discharge in bankruptcy (chapter 7) on the loan (assuming they are dischargeable debts) the creditors cannot continue collection. Your children would not be affected at all now or in the future except if you need student aid for them.

How can I get out of the $40,000 they think they deserve, but they did not deliver?

Answered by attorney Marjorie A. Guymon

If it's a privately funded student loan and not a federally guaranteed student loan then you may discharge it in bankruptcy. Or, you may file a civil suit against them arguing that they did not deliver the education that you contracted for.

You will need to prepare a profit & loss statement on a month by month basis. Be sure your business expenses do not include any of your home expenses and don't try taking an expense for a home office because it won't fly with the bankruptcy court. Exactly how the numbers will be used will depend on whether you proceed in Chapter 7 or through Chapter 13.
