Mark also defends health care clients, concentrating on alleged birth injuries and other catastrophic injuries.

    Mark manages nationally the defense of cases involving a variety of household products. He also frequently counsels manufacturers and other business clients on document and data retention issues as well as e-discovery issues. He is a frequent author and lecturer on these subjects, and was a member of a joint bench-bar committee establishing a proposed protocol for e-discovery in the United States District Court for the District of Maryland.

    Mark has authored and co-authored many successful Daubert challenges in products liability cases, including federal cases in Minnesota, Ohio, Pennsylvania and Michigan, two of which were wrongful death cases resulting in summary judgment (Booth v. Black & Decker, Inc., 166 F. Supp. 2d 215 [E.D. Pa. 2001]) and Knotts v. Black & Decker, Inc., 204 F. Supp. 2d 1029 [W.D. Ohio 2002]).
